These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Horizon Media Group Inc., an Alabama corporation ("Company," "we," "us," or "our"), governing your access to and use of Storm Call Pro, including all related software, services, and documentation (collectively, the "Platform").
Storm Call Pro is a paid, subscription-based storm operations platform designed for utility companies, contractors, and organizations involved in storm response and restoration. The Platform enables operational SMS messaging, crew coordination, and storm-related document management.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
"Account" means the Customer's registered account on the Platform.
"Authorized Users" means individuals authorized by Customer to access the Platform under Customer's Account.
"Contact" means an individual whose phone number has been added to Customer's contact list for operational messaging purposes.
"Crew" means a group of workers associated with a specific storm for organizational purposes.
"Documents" means files uploaded to the Platform, including receipts, invoices, photos, and other storm-related materials.
"SMS Messages" means text messages sent through the Platform via third-party carriers.
"Storm" means a storm event created within the Platform for organizational purposes.
"Subscription" means the paid service plan selected by Customer.
Access to Storm Call Pro requires a paid subscription. There is no free trial, demo period, or complimentary access. All Platform features are locked until a valid subscription is active and payment has been processed.
We offer multiple subscription tiers with varying limits on SMS messages, document storage, and data retention. Plan details and pricing are available on our pricing page. We reserve the right to modify plan offerings, features, and pricing with 30 days' notice to existing subscribers.
If you exceed your plan's monthly SMS allocation, additional messages will be charged at the overage rate specified in your plan (currently $0.03 per message segment). Overage charges are billed at the end of the billing cycle or when thresholds are reached.
Document storage exceeding your plan's allocation may incur additional fees. Current overage rates are $10 per 5 GB of additional storage.
If payment fails, we will attempt to collect using the payment method on file. After repeated failures, your Account may be suspended or downgraded. You remain responsible for all amounts owed.
Fees do not include taxes. You are responsible for all applicable taxes, duties, or government charges.
To use the Platform, you must register an Account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your Account credentials and for all activities under your Account.
You may authorize additional users to access your Account based on your subscription plan. You are responsible for ensuring Authorized Users comply with these Terms.
You agree to use the Platform only for lawful purposes and in accordance with our Acceptable Use Policy. You will not:

SMS messages are delivered through Twilio and mobile carriers. We do not control and cannot guarantee message delivery timing, success, or receipt.
You represent and warrant that you have obtained proper consent from each recipient before sending messages. You must:
The Platform allows you to upload and store storm-related documents including receipts, invoices, photos, and other files. Documents are organized by storm and category for billing and reconciliation purposes.
Your subscription plan specifies storage limits. We may restrict uploads if limits are exceeded.
Document retention periods vary by subscription plan. After your retention period expires, Documents may be automatically deleted. It is your responsibility to export or backup Documents before retention periods end.
We do not verify, validate, audit, or endorse any Documents uploaded to the Platform. Documents are stored as provided. You are solely responsible for the accuracy, legality, and authenticity of all uploaded content.
You may not upload illegal content, malware, sensitive personal data not necessary for storm operations, or content unrelated to storm operations.
Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You retain ownership of data you submit to the Platform. You grant us a limited license to use Customer Data solely to provide and improve the Platform.
We implement reasonable safeguards to protect Customer Data. However, no system is completely secure, and we cannot guarantee absolute security.
Upon Account termination, we will delete Customer Data in accordance with our retention policies, typically within 90 days. Some data may be retained longer as required by law.
We do not guarantee that the Platform will be available at all times or operate without interruption.
The Platform relies on third-party services including Stripe (billing), Twilio (SMS), and cloud storage providers. We are not responsible for the availability, performance, or actions of third-party services.
9.2 Liability Cap: OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We are not liable for: failed, delayed, or undelivered messages; actions of message recipients; third-party service outages; data loss due to failure to maintain backups; regulatory penalties resulting from your non-compliance; or loss of business opportunities.
You agree to indemnify, defend, and hold harmless Company, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
You may cancel your subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
We may suspend or terminate your Account immediately, without notice, if you breach these Terms, fail to pay, or if required by law or carrier requirements.
Upon termination, your access ends immediately, you remain liable for fees incurred, and we will delete your data per our retention policies.
If your Account is terminated for violation of these Terms, you are not entitled to any refund.
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Alabama.
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Company regarding the Platform.
We may modify these Terms at any time. Material changes will be communicated at least 30 days before taking effect. Continued use constitutes acceptance.
If any provision is found unenforceable, the remaining provisions remain in effect.
We are not liable for delays or failures caused by circumstances beyond our reasonable control.
